Question:

I want to start a business, but . . . ?

it looks like another company has the same name as what I want mine to be called, and they deal in the same type of business as I'm planning to go in (i.e. apparel and accessories). Another problem is that it looks like the name of the other company has a similar color scheme as I want mine to be.

I don't see any TM or R in a circle near the name/logo to indicate that the other person has registered or has put legal rights on the it. The website, however, is already copyrighted by "_" Industries.

So given these things, would it be illegal to create a company with the same name? If I proceeded to do so, would the person/industry who started the company have the right to sue me for infringement?

Note: when I put "name", it means I don't want to reveal the name of the company/industry. Just treat it as a blank.

  1. No.  You need to register the name with the state and if it's already taken, you are out of luck.
