I want to terminate my ex's parental rights. What do I do?

My daughter is three years old and my ex has never been a part of her life. He has actually made the decision to become a woman and I would like to terminate his rights incase he does decide to come around. I want to do this also because I am getting married and I would like my Fiancee to be able to adopt her once we are married. Can anyone tell me how to go about doing this???

  2. This is different state to state. You will need to look into your states particular laws. I live in Indiana and I had also looked into this, and my ex wanted to termanate his rights, but the court would not allow it becuase I am not remarried, they said there has to be another parent there who is going to adopt the child and take over the responsibility. they will not strip a child of a parent without there being a replacement expet for extreme cases were say, a non custodial parent has 4 or 5 different kids they owe support for, or they are thousands behind in support and the case is being tried on a criminal level. Call your court and ask them, see if there is paper work you can obtain to do it yourself, or if you can afford it get a lawyer, but it will probably cost, at the least, $500 to do an adoption and as much as $1,000 and that could increase if this is for more then one child.

  3. You can ask him to sign a paper agreeing to terminate his rights. This will also give him the agreement that you won't seek child support anytime in the future. Or you can hire a lawyer and get the judge to take care of it. But if you go to court, be prepared for it to last a while. He will have to be there to "defend" himself.

You need to look up your state laws.  It varies from state to state.  In my state a biological parent must be 13 CONSECUTIVE months of no support AND no visitation.  Support and visitation are separate items here.  Then, you have to file with the court and either inform the parent or publish a notification in a paper if you don't know the whereabouts.  Then you do the adoption...and again you have to check your state statutes.

  6. My friend went through this. In our state the parent having thier rights terminated has to be notified so they can sign the papers. Check with the courts in your state.
