I was a victim of a hit and run, the cops caught him. His he not liable for the accident ?

The problem was that I only had liability on my car. He blind sided me and hit me car and tired to flee but he was caught. Turns out he never had insurance on his car nor was it registered to him. I am now stuck with this bill and I don't know where to turn. Is my only option to try and sure him for the damages to the vehicle ? This is in New York also

  3. Unless you have uninsured property damage coverage, the only thing you can do is to file a small claims action.

  4. You'll have to take him to small claims due to not having collision coverage on your car.  

    As for him going to jail, just like everyone else..it depends on his track record.  You don't go to jail for not having insurance.  They may impound your car and issue a citation.  Be sure to fill out an SR1 if you in CA...this notifies the DMV also that he's an uninsured motorist.

    Get a lawyer?? For what, then you have another bill you have to pay.  Obviously, this idiot didn't have the money for insurance.......how's he going to pay for your damages??

    Just an FYI, I have never heard of the state paying for anybody's damages!!

  6. File under your uninsured motorist property damage on your policy.  Call your company & tell them what happened.  You will probably have a small deductible to pay.  It should say on the police report that there was no insurance on the other vehicle.

  7. You can try and sue him, but unless you had uninsured motorist on your plan thats all you can do :(

  8. You could sue him, but for what? If he has no money to pay for insurance, do you think he has money to pay a judgement against him if you win in court?

  9. NO- he is liable.  He just doesn't have liability insurance.

    You will have to sue him.  You will win - easily.  They will either impound his car or he has to pay somehow - not your problem how.

  10. If he has no insurance, and the vehicle wasn't his, chances are excellent he also has no money or assets, so you could win in court and still get nothing.   Sorry, but that is realistic.  A lawyer will advise on the likelihood of collecting.

    I don't understand why people buy only liability cover.  If you drive a beat-up junker you can replace for next to nothing, it is one thing, but anybody who can't afford to replace their car ut of pocket at a moment's notice can't afford to carry only liability coverage, because it is not car insurance in any way, shape or form, it is only coverage for the damage you do to others and their propery.

    And the state doesn't pay for the damage to your car!
