I was convicted a year ago as being in charge of a car whilst drunk - can i get a green card?

is this a motoring or criminal conviction? will this be on my records what the ACPO produce re criminal file?

  1. A conviction for being in charge of a motor vehicle while intoxicated is not a crime involving moral turpitude unless you did it while your license was suspended.

    A conviction for something which is not a crime involving moral turpitude almost never creates a ground of inadmissibility. There are a few exception, I know, but your conviction is not one of them.

    You don't need a pardon. The U.S. doesn't recognize foreign pardons. You don't want to get the record expunged as the U.S. would not recognize that either, and if you failed to reveal your conviction, that would make you look worse than revealing it.

    If this is your only conviction, feel free to reveal it. It will not work as a stop to your attempts to obtain a green card.


  2. Unless you apply for and get a pardon, the chances are that you cannot ever get a green card. Because before you get the green card you an probation to determine whether you are suitable material for citizenship. There are millions who want into the USA and thus they are not to keen on the idea of accepting people who have proven they may do criminal activity.


  3. I am afraid it's criminal... However, I think you have a great chance of getting your green card, but you need a good immigration lawyer for that. You may also find out if your record could be eligible to expunge (clear). You would need a criminal attorney to find that out for you.
