Question:

I was denied by immigration for change of status what can i do now??anything may help i cant leave my family?

I came to the us from jordan in 2005 i got married but my marriage didnt work out ..i was advised by an attorney to stay married until immigration processed my papers ..now i have been denied and that takes away my work authorization card ...i need help anyone that has been through a similar situation ..or can give me some kind of legal advice ..or the name af a good immigration lawyer ..my lawyer says now he cant help me because i am arabic i am a hardworking man ...please send me some suggestions to help me ..i have a girlfriend w/ 2 kids and i love them all very much i want to marry her and try to have a good life ..we are very worried now about our future ....jennifer_and_zaid@yahoo.com

  1. No immigration lawyer can help you now.  You must return home to Jordan.  If you return home for at least a year, your current girlfriend might be able to apply for a fiance visa for you.  If approved, you could return and marry.  

    However, you have a bad marriage (and possible marriage fraud) on your record, so the chance of getting another fiance visa and re-entering the US is very small.  On the other hand, if you do not return immediately and voluntarily, you have no chance at all every coming back to the US.  You will be deported on marriage fraud charges, and with fraud charges, you can't get a visa to go anywhere at all.

  3. ibu guru thinks anyone who married a immigrant has done it for fraudulent reasons. If you were denied your change of status it could have been for a few reasons. Like changing from a visitors visa to permanent resident. The best thing for you to do now is one of two things. 1) Divorce your wife and marry the new girl.. return home.....file a I-130 or 2) divorce your wife go home and have the new girl apply for I-129f .... Make sure you have proof of your new relationship. It has nothing to do with you being Arabian and it is not legal for the lawyer to discriminate because you are Arabian. Maybe he said he could do nothing for your case.

    Don't risk being able to live and work freely in the USA by overstaying and becoming illegal. Go home to Jordan and contact the American Embassy in Amman.. Be careful of lawyers in Jordan some do not know the laws and will cheat you. If your new girl goes to Jordan with you, the Embassy will require that she has residency in Jordan for one year before they will even make an appointment to file in Jordan and do consular processing.
