I was driving home one night and I had been at a bar. I was pulled over for speeding. I was not speeding the officer seen us leave the bar. I passed him going the opposite way and seem him turn around, I told passengers I bet he is going to pull us over because he seen us leave. He did he didn't tell me why just said "I smell alcohol get out of car. I refused all sobriety tests. I was taken to Hopital they got a warrant took my blood, charged with owi. I was never charged with speeding at all. I honestly was not speeding he lied on the police report. Is this legal? I know owi is illegal but shouldn't they have a real reason to pull you over and why didn't I get a ticket?

  1. your story is not very clear.  You say he pulled you over for speeding, then later you say he didn't tell you why.  You were probably driving erratically.

    Pulled over.

    Thought you were pulled over for speeding.

    Officer smelled alcohol.

    Officer asked to do a Breathalyzer / refused to.

    Warrant to take blood.

    Did not get a ticket.

    And your out running around again?

  3. Police can pull you over just to question you or check out your "state" after leaving a bar. I see cops doing this all the time outside bars at 3am. And whoever said you should have refused the breathalizer test is right!! That is like signing yourself into jail.

    Dont drink and drive, it kills.

  4. Speeding or not..you where at a bar and the officer had every right to pull you over. Its was not smart on your part to refuse a Breathalyzer. You darn right OWI is illegal. I do not know why you did not get a ticket, but the cops did their job getting a drunk off the road. bravo to them!

  5. he used speeding as probable cause to pull you over and thank god he did even if you don't feel you were drunk you probably were especially if they charged you for being over the limit. Whether you were arrested or not it is the officer's choice to ticket you for the original reason to pull you over. Since police officers are not required to show proof of speeding yes it is legal maybe not moral. Just know next time you go to the bar take a cab or use a DD! Sorry this happen but it could always be worse I've had three friends killed but drunk drivers 1 of which who was barely over the legal limit. Good Luck and God Bless

    No sympathy from me. You got what you deserve and hopefully the judge will give you the same.

    No, it's not legal to lie on police reports.

    They should have what's required under our system of law; reasonable suspicion.  Just leaving a bar is not reasonable suspicion.

    No way to know.  None.

    Shame you didn't post what your blood alcohol content ended up being.  Might have been very telling.
