I was found intentionally homeless 6 months ago and have been renting a private flat with my two sons for 6 months but now he is selling the flat that we are living in. Can i go back to the council for help.

  1. Yes you can.  As you have had settled accommodation since your last homeless decision and therefore are making a homeless application on the basis that you are going to be homeless from your current accommodation.  

    They will look at: What is the contractual period of your current tenancy - was it 6 months or a year, 2years...?  Have you been served notice to quit?  Have there been any problems with your current tenancy? Do you have any rent arrears?  

    Your landlord can sell the property with you as a sitting tenant and you would become the tenant of the new landlord.  If this was to be the case then you would not be homeless or threatened with homelessness.  Also if you have not been served notice to quit then you can remain in the property.  If the contractual period of the tenancy was greater than 6 months then you cannot be served notice to quit which expired before the end of the fixed term.  

    If you landlord was to say he wants possession of the property due to poor behaviour or rent arrears etc then it is likely you would be assessed as intentionally homeless again.

    I would advise you to approach Shelter in your local area who can advise you and support you through your application.  If you get an adverse homelessness decision then they can help you appeal it and they will really back you up and fight your corner.

  2. Jeez Chappye7.!!  Who said she wasn't working??  There wasn't enough information provided to justify such a scalding remark!   Getting a council house isn't looking for handouts.  I "work my butt off" to pay rent for my council house, does this make me a "handout scrounger"???

    Anyway, I think the rule is, 1 year suspension from the housing list.  However, given your new circumstances, they will reconsider.

  4. If I had two sons I would be busting my butt working to provide for a better future for my kids. Not looking for handouts.
