Question:

I was hit and have damage to my passenger front door and my fender is ruined.?

The individual that hit me has front damage but claim that I hit her!! The police report has me as the secind car but didn't say who was at fault. I don't understand how anyone can say I'm @ fault when I the paryt with side damage and her radiator was smoking and hood in the air. All help will be appreciated guys.

  1. 9 times out of ten, police do not assign fault.

    Most adjusters are very good at determining who did what in accident. Their training is very intense and quite thorough.

    Talk to your insurance company, that's what you pay them for.


  2. The police report, they don't assign fault, they report factual information.  You turn it in to your insurance, and the other party does the same, and the insurance companies make the decision who is at fault and to what extent.

    Just because you have side damage doesn't mean you aren't at fault.  You could have run a red light or stop sign and received side damage.

  3. answer your adjusters questions and he/she will look at both car's point of impact and decide which drivers story makes since... if you lie they can tell by the area of damage - good luck

  4. Please remember that the job of insurance adjusters is to determine fault of accidents or shared fault.  This is done by police reports, witness statements, pictures of vehicles and general location.  All of this information is reviewed and fault is assigned.  They will basically try to determine which story paints the best picture.
