I was hit by a car and the other driver's insurance company?

has accepted my calim. But they are saying thatthey would not pay for a minivan rental (mine is a minivan) as in NJ they are required only to provide transportation and not a like vehicle. Is this true or they trying to con me?

I'm sure this could be different from state to state and from insurance companies.. but any time I have been involved in something like your case.. insurance companies only allow so much money for rental cars, not necessarily enough to cover the car you may want. If you want a better car you will need to pay the difference.

  4. You may have to get your insurance company involve so they fight for you, otherwise there company with give you the shaft.

    I know as it happened to me, it sucks to be involved in any accident as it can get complicated. As for the rental who cares happy you got a rental, some won't even offer you that.

  6. The same thing happened to me one time so I say there telling you the truth but at least they will pay for some type of transportation,its better than none.

  8. Not sure about NJ, but the insurance company is not conning you.  They are state regulated and the claims rep cannot just provide you with incorrect info.  

    Ask to speak to a supervisor, or contact NJ's Insurance Commissioner.

Unless you are running a commercial service, and have commercial plates on your van, and commercial insurance, no, they don't have to pay for a minivan, all they have to do is get you a car that can get you from A to B and back again.  If it were a business things, then yes, they would have to, or compensate you for lost business.

    So they can get you a car when your pickup is damaged, or a car when your van is damaged, etc. etc.

    Why would they try to con you?

  11. They will only pay what they are legally required or contracted to pay. You could pay the difference, maybe. If your 1957 Chevy Belair was damaged, do you think they would have to rent you one of those?

  13. Since laws can vary by state, I'd call an attorney or your own insurance company. They should have to stay on top of this stuff and may know the answer better than most of us.

    Did you ask what they meant by providing transportation? What do they think cars or minivans are? Flying ducks?

  14. Ins. Co.'s are not required to pay for the same type of vehicle or one thats more expensive then what you have..... Their ONLY requirement is to provide you with transportation - so dont bother fighting it - your only wasting your time.......

  15. that is true where i live so would not be surprising that the law is the same in NJ in WA they just had to give me a car and i went from a suburban to a cobalt how that makes any sense i don't know but i still got a way to get from A to B  

  16. I would talk to your own insurance company and they would be able to tell you . You insurance company might be able to provide this also .

  20. You would be better off if you called the commissioner of insurance

    at the state office building. The answers you get here will just make you frustrated, as most people would be, if it had happened to them.

  21. I think you'll find that true in most states. In some places they don't even have to provide a rental.
