I was hit by a car whose insurance has expired.?

The police report said the car who hit our car, in which I was at the passenger sit besides the driver, has liability insurance. But when we claimed to his insurance , they told us after three days that his insurance is expired. I have bodily injury and our car is totally damaged. Our insurance is liability only. the accident happened on june 8, 2008. The other driver was drunk and the police gave him a DWI ticket. what shoud we or I do next??

Well he will lose his license and has to go to court to face the music.  You will have to end up suing him personally for the damages.  Take him for everything he's got, get what you can!  Maybe they will put a lean on his house, garnish his wages, and give you whatever he has in his bank account.  Good luck!

  3. Wow. I'm really sorry. I was in that situation earlier this year. First and foremost, get in contact with a lawyer. Secondly, check if you have uninsured motorist protection, because if you do, you really don't have much to worry about. Don't become an ambulance chaser, please. Be truthful about your injuries and don't exaggerate. If you don't the insurance, you will need to settle with the attorney

  4. If you haven't already, contact your insurance company to get advice.  If it indeed turns out you have no coverage, you would have to sue the other party in order to recover your losses

  5. Get a lawyer and you will have to sue the driver and / or the car owner.

  6. well you may have coverage on your policy even though you only have liability.  call your agent and see if you have uninsured motorist coverage.  if you do you may be able to file under that on your policy.  in order to recoup your loss you are going to have to either get this guy to pay you out of pocket ( which he wont since he had no insurance ) or sue him.  in the latter case you will end up paying a lawyer and court costs, etc...and then even if you DO win a judgment there is nothing saying he will ever pay you.  Good luck
