  1. That probably depends on the state laws where you were hit but usually the insurance companies will base it on the amount of damage done to you determined by the hospital that treated you.Be careful about settling to fast sometimes even 1 year later you can have problems arise but once you've settled it's done. For bumps and pulled muscles I got 1500 but if something was broken or multiple doctor visits were required should be more . Wait and see what you are offered and ask for more. Good luck!!

  2. Maybe nothing, depending on the circumstances, which state you live in, YOUR insurance, etc.

    Ask your agent.

If you're asking, is there a rule that says you get three times your medical bills, the answer is no.  If you HAVE no medical bills, you won't get pain and suffering, either.

  3. What pain and suffering have you had?

Depending on the company, they might offer you $500 to settle the claim. (You don't have to have medical bills to get a settlement. Sometimes they are willing to pay you to 'get checked out', knowing that you are really going to pocket the money. It is worth it to close out the exposure.)

If you have an actual injury, and have sought medical treatment for this injury, the amount of the settlement various based on a bunch of factors.

  4. First, just because he was drunk has no bearing on how much your claim is worth. It might've contributed to him being at fault for the accident, but you don't get more money just because someone was drinking. And no one can answer your question here. It all depends on the types of injuries, what kinds of rehab did you have to do, did it affect your daily activities, and is so, for how long? There are MANY, MANY different factors that go into injury settlements, and no one here could tell you what your claim is worth.
