a suburban hit me on july first he had no blinker on my bike is totaled and i have a separated acl witch is a separated shoulder i also lost my job i hired a laywer for 25 percentof settlement i paid 12,000 for my bike but still owed about 8,000 but i had full insurance and gap insurance does any one know if i will get money back for a new bike and also about how much of a settlement for this injury i am in alot iof pain and cant even wipe my own butt ive been riding seven years and never been in a accident any info would be appreciated

    Are you sure you have an ACL tear of the shoulder????   The ACL is in the knee.  Anterior Cruciate Ligament.    Perhaps you mean Acromioclavicular Joint Separation

    Nobody can answer this question with the limited info you have provided.  

    Will your injury require surgery?  Are you still treating?  What kind of treatment?  How long will you be totally disabled?  Partially disabled?  Any permanency?  Oh, I can answer that.  Way too early to know if you will have any permanency or loss of function.  The loss occured one week ago.  

    Assuming you are tort eligible, your claim will be evaluated once you have reached a medical end result.   Your meds and lost wages will be included in the settlement.

If the ACV is less than what your owe your GAP insurance will cover the difference. You will not owe anything out of pocket but you will not get any money for your motorcycle. Your carrier will then subrogate or seek reimbursement from the at fault carrier, including your deductible. When they recieve their reimbursement you will get your deductible back from your carrier. Lets dicuss your bodily injury claim. If the bodily injury policy limits are $25k or less I would recommend a tender of the policy limits to you. A torn ACL could require surgery. Motorcycle claims are generally considered dollar one claims. Meaning that most people who have motorcycles don't have injury coverage and most car insurance companies will not pay for your first party injury claim if you were not in your car at the time of the loss. Therefore, the bills your incur would be owed to you from the first dollar spent. A few things to keep in mind are that the attorney is going to take his percentage off the top, he can then help you to get your medical bills reduced and the attorney should make sure that any liens are satisfied. Some hospitals place liens on the treatment you receive which is to guarantee that they get paid back for their services. If you decided that you want to forgo the your attorney, be aware that the attorney can also place a lien against the settlement you make with your insurance company so that he/she gets paid for the time they have already put into your case. Again, if the BI policy limits are $10 or $25K I personally would recommend a tender due to possible ACL surgery.
