I was hit by an uninsured motorist and I was inquiring about how much could I receive?

I have full coverage on my vehicle and i've just been recently released from the doctor. I paid the deductible for repairs on my car and i'm impatient. Since you guys always have the answers thought maybe i would ask you..

  1. We were rear ended by a drunk driver racing his car. My wife broke her neck. He didn't have insurance and this was his third DUI.  Luckily, we had Un-Insured and Under-Insured coverage on our policy ( a must have here in CA) and eventually had to get an attorney to sue (actually threaten to sue) our own insurance company to get any money at all.  Ended up o.k., I guess, but sure could have been a lot worse without that coverage. I believe the Un-Insured takes you to the state's minimum amount they require. The Under-Insured takes it to levels necessary to fully cover damages and injuries, pain and suffering caused by the other Un-Insured, Under-Insured motorist. Since ALL insurance companies operate under three basic tenets....1. DENY, 2. DENY, 3. DENY, we finally had to obtain the services of an attorney familiar with these types of cases.


  2. Ask your lawyer!  He's taking 30%!!

    You won't get more from YOUR policy, than the policy limit.  

    Or, medical bills, plus maybe something, maybe nothing for pain and suffering.

    But whatever you get, you're lawyer gets his cut, FIRST.

    You don't say what the medical bills are, you don't say how badly you were injured, you don't say what your UM limit is.  

    Anyone who gives you a number, based on no information, got it by wearing their magic hat.

  3. if you have full coverage on your car and filed the claim on your policy i am not sure why you have a lawyer other than you like giving your money away.  your insurance company would pay the claim, then go after the other party for you, FOR FREE!  thats what you pay them for!  good luck

  4. you'll only receive an amount that you were insurered for if in fact you had uninsurered motorist coverage and then it might not even be in the full amount you're paying for. plus you're rates will sky-rocket and they might possibly drop you as a client. Good Luck, ins co's are f'd up these days

  5. Well if you want to be a jerk about it you can get how much you paid for all your medical and stuff. If the injuries you relieved didn't debilitate you for some time you shouldn't sue him because he may be in some hard times. Though if you were out for awhile then you should sue.

  6. You have a lawyer.

    You will be giving your lawyer a very large chunk of any settlement you receive (usually 1/3 plus expenses).

    Since you are paying the lawyer such a hefty fee and he knows the specifics of your case.....ASK HIM.       THAT'S WHAT YOU ARE PAYING HIM FOR.

  7. Depends on what state your in and the laws there, your coverage limits and how bad your injuries are.
