Question:

I was hit by another car while making left turn, I had to bypass incoming traffic lanes to turn onto 1 way St.

Light was green, I saw it was safe to make a turn, initiated the turning maneuver and had already turned onto the 1 way Street when out of no where this car hit my bumper on the right side and took the bumper completely off. He had only right front damage. He claims I drove in front of him and I say he had to be speeding. If I drove in front of him wouldn't he had hit me with the full front of his car?

  1. If you are saying that he was driving straight and you turned in front of him, you caused the accident. Even if he was speeding, you were supposed to wait until it was safe for you to make your turn. You had to have seen him coming, or you SHOULD have seen him, at least. As far as his damage to his vehicle, it is irrelevant. You should have gotten a ticket, if the police came out.


  2. Normally the person who was going straight would have the right of way over someone who was making a turn, but in your case, it looks like you already had control of the turn and were already there when he hit you.

    If the damage is mostly to the front or side of your car (a t-bone) then it would be mostly, if not completely your fault but if the damage is mostly to the rear of your vehicle, then he would be mostly at fault.  In any case, it's up to the insurance company to assign fault to whom and to what extent.

  3. I would say that it should be his fault.

  4. did the police respond to the accident? were you given a ticket? if not don't worry about it and let the insurance companies work it out.
