I was in a Car accident at a red light with no Car insurence. Need an answer.?

I was in a car accident at a red light the person behind me hit me in the rear and then i hit the person in front of me doin no damage to them. Now im not worried about the damages to my vehicle, but the person who hit me really messed up there Grill on there car. There was no injures involved. I do not have insurence at the moment but thought i did. Im having to goto court about this and was wondering what will happen, like will i have my Licence taking away from me and will have a ton of fines? None of this was my fault. The person who hit me said there foot slipped off there break. And the person in front of me did not take any damage to there car. Im really worried about losing my License. And would it help if i went into court with Insurence?

  1. Insurance or not, the person behind you is liable for your repairs.  In regards to going to court, best thing is to have insurance when you go.  Your still going to have to pay a fine for being uninsured, yet hopefully it's first offense.

    hopefully, you will lose your license for a few months along with a nice fine.

    when you get it re-stated, another fee, and you will have to have SR-22 filing so that if your insurance lapses for any reason, the company will notify the state so that corrective action can be taken.

    you will not get any sympathy from most of this board.

  3. You are going to be fined and depending on your age and the state it  happened in they might take your license. Doesn't matter who was at fault you did not have insurance. You should make sure you do when you go to court.

  4. If it wasn't your fault you won't have to pay anything. Also most states just require you show up to the court date with proof you had insurance the day of the infraction, and you face a fine if you don't.

  5. I'm afraid it's rather serious, especially since you were in a car accident. Each state has a different law on the matter, with varying degrees of severity, but it's almost certain that you will have to pay a fine of some kind.     If you can prove that you were unaware that you didn't have valid insurance than that will help your case significantly. I think it would be very smart to get valid insurance before you go into Court. Best of luck.

States are really cracking down on no insurance.  There will usually be a fine or probation.  You should definitely show up in court with insurance.  You may be required to show up every month or every three months over the course of a year to prove that you have maintained insurance.  I really don't think you'll lose your licnese if this is your first infraction, but i'm glad to see you're taking it seriously.

    As long as you don't live in Lousianna they should take care of your damages.  you were rear ended and pushed into the party in front of you.  In Lousianna you're not abel to collect insurance if you are uninsured  even if you're not at fault.

    Despite popular belief not every time you rear end someone are you at fault.  you are not at fault nor are you liable for the vehicl in front of you.  they stopped, you stopped, the third vehicle could not stop and therefore was  the proximate cause of the loss.

  7. No only will you go to jail, you will lose your license.  Take the time while in the link to brush up on your spelling.

  8. In CA you can lose your license for a year. But if you buy some before court they will usually overlook it.  

  9. You best hope that person is covered that hit you or you have to go through the courts and grab a lawyer to get anything done!

  10. It may not have been your fault but the bottom line is you should not have been there with no insurance.  

  11. you should have at least had third party insurance. Your not technically at fault however you get done for having no insurance.

  12. I'd say you are going to be fined and may get a license suspension for not having insurance. I live in Ohio and here you don't go to court for not having insurance. The state contacts you and suspends the drivers license for 90 days on first offense then to get the license reinstated you have to pay a big reinstatement fee. Going to court with insurance might or might not help as far as the fine goes with the judge. The insurance card will have the date the insurance went into effect.

  13. Anytime you hit someone from behind, it is your fault...even if you were pushed into a vehicle by being hit from behind yourself.  

    I doubt you will lose your license, but you will take some heavy fines.  Going to court with insurance might make the judge go easier on you as you have tried to correct your error (and goes along with your story of you thinking you had insurance).  You might get insurance now as it might be more difficult after you have a judgement against you.

    The best advise is to get a good traffic lawyer.  Although you may think you cannot afford one, you probably really cannot afford to be without one.
