I was in a RTA and my partner was driving, can i now claim for my injures off his insurance as he is only tpft

i have severe whiplash, back damage and also neck and shoulder injures..... I am suffering severe headaches and dizzyness and have been signed off by the hospital and given a lot of drugs to help the pain....

  1. Yes you will be covered by the 3rd party section, it is just him that would not be covered for any injuries to himself.

Yes, as a passenger, you are covered under the third party section of a third party fire and theft policy, but if nobody else is claiming off your partner for this accident, you need to bear in mind that if you claim, your partner will lose some or all of their no claims discount unless it is protected. It is worth weighing up how much the insurer would penalise your partner for making the claim and compare it with how much you are likely to get for your injuries to see if it is worth claiming.

  3. yes you can. ring your insurers and let them know you were injured. they will set up a claim with their uninsured loss recovery team who will contact you and deal with that section for you

  4. As a passenger in the car you are a third party irrespective of who was at fault. If it was your partner at fault you claim for personal injury from his insurers and if it was the other car ... well you get the message.

    To claim look for a solicitor in your area that offers no win no fee (I hate that term) or ring one of the nationals advertised on television. They will all give you a consultation to ascertain the likelihood of success and you can move forward from there.

    Sorry to be the bearer of bad news but If it was the other persons fault you could claim off their insurance otherwise unless you are fully comp you don't have a chance....sorry. Insurance companies are sly as foxes and will try to wriggle out of anything they can.

  7. yes you can claim from his insurance as you are a third party. if he was injured he cannot claim from his insurance as he is the first party
