I was in an accident 14 months ago. It was not my fault i was injured and sent to the ER. I was on the clock and missed around 20 days of work. Workers comp paid my medical and now the ins company trying to repay the workers comp back with my settlement. They only offered me $18,000 $9,000 of which is going to workers comp. I don't feel $9,000 is enough for my pain and suffering. What are my options?

  1. It sounds like you are $450 a day ahead of the game when all is said and done.  I was legally handicapped for several months after an accident, and didn't get clearance to work for 10 months.  At that rate, maybe I should have received $135,000.  I was happy with $18,000 over and above replacement income, and all expenses.


  2. If you don't have a Lawyer, your chances of being cheated is much higher. Fire them back an outrageous figure and take it from there.  

  3. I've found that usually you personally receive the same amount of money as the cost of the medical bills or workers comp.  So you got a pretty good deal.  If you feel you did not receive enough, ask your insurance company if they will pursue the claim further or if you can use your own lawyer (you don't pay unless we win).

  4. Your options are to refuse the settlement if you don't feel it's enough.  They may offer more, or they may withdraw their offer completely and let you start over.
