I was in a car accident and insurance wants to settle?

I was a passenger and the only one in my car to go to the hospital. I'm better. I have a couple of questions.

1. I gave a bill to my husband's insurance company which they paid, should I get reimbursed for that?

2. should I get the money back from what my medical insurance paid?

3. They offered me a settlement of 1250.92 then are going to take away from that 65.10 to give to my husbands insurance company for the ambulance bill, should I have one settlement and the insurance company have a different one so they're not taking away from me?

NO I'm not trying to s***w over the insurance company, I'm just trying to learn what to do so I know for next time (and hopefully there won't be a next time!)

  1. The way it works with the medical insurance is that they subrogate the benefits which means that they will pay but get reimbursed when your auto insurance pays.

    It's important to note that your health insurance company will likely not pay for any future costs of this accident after your auto insurance pays.  So if you accept $1000 as payment in full and you develop back pain next year your health insurance will deny it and your auto insurance will say that you were paid in full.

    If there is ANY chance that you will have future problems it's probably worth a few bucks to have an attorney look at the settlement agreement.
