I was in a car accident last night.?

I was on my way home last night and i got off the highway and its one of those that loops around and you hafto yeild to merge with traffic. Well i was comming off and thier was an older woman in front of me and when i got closer to where i had to merge i looked to my left to see if there was any car comming BAM! She STOPED!!!! WTF is the first words that came out of my mouth when i opend my door. I had rearended her @ 30 mph. My Pontiac grand am was sorta messed up in the front. her bumper was scratched up. The police come and I got cited for the stop for not keeping distance and for not stopping. The question i have is that woman stopped and your not allowed unless there are cars comming and you couldnt merge. Should i get my lawyer involved????? The accident wasnt my fault. Any to clarify things there were no cars comming when you had to merge!!!!!!! That makes HER more at fault than me becase if there where car then it would have been my fault. Thanks.

  1. sad to say but if you hit anyone in the rear end it is automatically your fault even if it wasnt laws suck sometimes


  2. man get a lawyer.  if he says you have no case, get another one a sue him for malpractice.

    the woman should be at least 50% at fault.

  3. It sounds like you may have been following too close and you were not prepared to stop quickly in case of some emergency.

  4. Sorry, it is your fault. You have to make sure they have made the turn/merged before you start checking your blind spot.

    BUT - Me321me said - Any accident that occurs when one person rear ends another person (regardless of the circumstances surrounding it), - - that is incorrect but lots of people think it's true. There are some circumstances that the person in front could be cited - like if someone cuts someone off and then goes too slow. The person in back might not have the distance to slow down and it was the person in front's fault.

    You should have allowed enough stopping distance for any sort of emergency stop.

    No matter what her reason you should have been able to stop.

Any accident that occurs when one person rear ends another person (reguardless of the circumstances surrounding it), makes it immediatly the person who did the rear ending's fault for failure to allow adequate distance between vehicles.   (Not a great law as far as I am concerned, but a law, nonetheless.)      So sorry that this happened to you!   Hope this helps!

  9. you should have been looking in front of you because it wasn't your turn to merge, there was no need to be looking to the left because she was still in front of you and you were to close. Sorry pal but your bad, suck it up.

  10. i hate when that happens. no you are supposed to have control of car all the time. i was an accident investigato at a cab company for years. getting a lawyer would be a waste of money. i am glad no one was hurt.
