I was in a car accident over the weekend. Who's fault is it??!!!?

I was driving in my lane and the car next to me speed up and came into my lane. She did not check to see if another car was in the lane before excellerating and changing lanes. The accident occured around 9:15 pm. I was coming out of a well lit parking garbage and didn't have my lights on. It wasn't dark enough to need headlights at this time. By the time the police came and the report was made, it was fully dark. On the police report, it states she came into my lane but it also states I didn't have my lights on. Who will pay for the repairs to my car? I also live KY

  1. Contributory negligence. You didn't have your lights on, she didn't see you. You are each partially at fault.


  2. Were either one of you fined? If only one was fined, it will probably be their fault. If both, it may be each take care of their own damage. Did she use her turn signal when she changed lanes?

    Most regions require headlight use by a certain time after sunset. So that could factor in.

  3. Did you get a ticket?  If so, you're at fault.  If not, your best bet is to call the police station and ask for a copy of the police report.  Not 100% sure on Kentucky law, but in most states the driver who hits the other car is at fault.

  4. Im am from the uk and deal with car accident claims, If it was daylight then it certainly would be the other drivers fault, but if its your word against hers in the uk this would go 50/50 liability. Hope this helps

  5. Sounds like both parties were guilty and both parties contributed to the accident. Go to your local yellow pages and find a local traffic attorney and he will help you with all the details.

    Were you driving in your lane without lights or were you coming out of a out of a well lit parking garage without lights?

    At 9:15, I'd say it was dark enough to need headlights. Sure, it may not have been dark as night, and I'm sure you could still see in front of you. But headlights should go on when the sun goes down because it starts getting dark and the lights provide <i>other</i> vehicles a much better view of vehicles on the road.

    I'm thinking if your lights were on at the time, she would have seen you coming out of the parking garage. Why did you exit the parking garage while a vehicle was heading toward you?
