Question:

I was in a car accident that was less than $400. In the state of California, do I have to claim?

It was my fault and no one was injured. I just want to know by law, do you have to claim an minor accident if it's less than $400, and do I have the right to shop around to pay for the accident by law?

I was not on the insurance, but the car had insurance. Can anyone help?

  1. The law is the same for all states......you have the right to shop around however the estimate that you get cannot be higher than the estimators original one unless there are other items that have been hidden and missed........

I'd say your best bet to get good answers is to call the insurance company that the car is insured through even though I know you aren't on the policy or have the person on the policy call them with your questions.  They will be able to help you to figure out what you can do.  I am supposing an estimate of $400 was given to you, you don't say who sustained the damage.  I was in an accident several months ago and I filled out a form I sent to the DMV but you may not need to do this.  I urge you, talk to the insurance company the car is insured under.
