I was in a car accident where the person behind me rear-ended me and pushed me into the car in front of me.?

The guy that hit me is the president of a bank and he was driving a company car (2008 Suburban) and the insurance he gave us for the police report is his business insurance, Zurich. My mom was driving and I was a passenger. We both suffered back injuries...mine are minor compared to my mom's...she has a fractured compressed T-5 vertibrae and will need to have surgery to fix it. My main concern is the fact that I have had numerous panic/anxiety attacks since the accident and have not been able to return to work due to them. My physician put me on Prozac and referred me to a psychologist. The psyc said that I am suffering PTSD and compared my anxiety level to "Def Con 5". I am not the type of person to not go to work. I love my job, and I even work at home in the evenings and on weekends from my laptop at home. Since the accident, I have a panic attack just thinking about the smallest things, much less having to go to work. Any advice on how to handle? Should we pursue a lawyer?

You need to talk to a lawyer RIGHT NOW!  Trust me, I worked for Personal injury lawyers for years and saw people get screwed by insurance companies all the time.  Sometimes you can ruin your case by not having a lawyer in the beginning.  The PTSD isn't going to fly with the insurance company, they'll offer you a measly few dollars (if that) and you'll be stuck with the pain and suffering for a very long time.  Get yourself a lawyer right away, they will fight for your rights and ensure you get the most for emotional and physical damage, if you don't have a lawyer the insurance company will NOT offer or give you what you deserve.  I once dealt with a client who had some serious neck injuries that required surgery and treatment for two years.  The entire time the adjuster was very nice and understanding...they told her to keep going to the doctor, promised her they would take care of all her bills and make sure she got all better, 5 days before the statute of limitations was up (the date you can legally file a lawsuit, ususally two years from the accident) they stopped communicating with her, completely ignored her because once that date passed, they didn't have to give her a single dime!  Insurance companies are the real vampires.  Get a lawyer to evaluate your case, theyll guide you in the right direction.  Good luck!

    P.S.  Hiring a PI lawyer wont' cost you any money until the case is resolved.  They'll pay for all the expenses and just because you hire them doesn't mean you're "suing" the other person.  It just means they'll be handling your claim.  If the insuracne company doesn't cooperate or offer appropriate compensation (enough $$) then they'll file a lawsuit with the courts.


  2. sorry this happened to you. panic attacks can be stressful, i have mine under control.  but, i feel like i have to be the one in control all the time.  i am the driver no matter who's car, i freak out driving in rain, i don't like it when someone knocks on my door, . i take Xanax for my problems and they seem to help, but when it is time to call in a new scrip, i panic, thinking they won't give me another month's supply.  i know this sounds like a cliche', but it is like riding a horse and you get thrown, just get back on, take 'baby steps' maybe this will help.  take a small drive to the post office or store. go slow, watch every other car on the road and you know, prayer helps, as does a seatbelt.  i say a small prayer before i drive and one when i get to my destination.  Good Luck.
