It was a minor accident no injuries and my insurance ran out 3 days before the accident, i have got insurance again but

The person I was in an accident with is taking me to court to try and get $2800 for the damages. Now I know his vehicle is not worth more than $1000. Could that mean that I can pay the price that the car books for and then he will have to give me the title, like insurance companies do?

  1. You will never have to pay more than the car is worth, whether you had insurance or not.  Get the blue book value and bring it into court with you.  You will not get title because technically you are paying to have the car repaired or replaced, the cheaper of the two.

  2. uh....YOU HAD NO INSURANCE. You're not totaling the car; and you aren't dealing from a position of strangth here.

    Settle.

  3. Did the other person have insurance?  If so, his insurance company will pay, then they will sue you for whatever they paid him.

If he does not have insurance, you need to settle out of court ASAP if this was your fault.  Even if you pay more than what the vehicle is worth, you will save court and attorney fees.

  4. You will have to pay for his damages, his medical expenses and his attorney, as well as other court costs.

He will not have to give you anything.

Personally, I think you should get a jail sentence out of it, but that's just my opinion!
