  1. Probably in the end they will, but in the mean time you or your insurance will be responsible for any debt you incurred. The insurance company will fight it at first until your insurance gets their case together. You may want to contact a lawyer for your own protection either way.

  6. Yes, they do. But he has limits. If you get an atty, he can send a disclosure letter to them and by law they have to tell you his limits. Can be as low as $10,000 and as high as $500,000. Then, you treat and bring a claim against his insurance. If they deny it, take them to court. If he was at fault, they are responsible up to the limit of his policy. You can do this with or without an atty. by the way.

  7. Yes, but sometimes it is YOUR insurance company that has to sue HIS insurance company for you to get them paid.  Talk to your ins. agent or a lawyer.
