I was in a minor car accident a few days ago. It was snowing out and there was a good amount of snow on the ground, i was in stop and go traffic on your average busy street so i wasnt speeding or anything, the car in front of me put there break lights on so i breaked immediately (not hard) and i knew i wasnt stopping quick enough so i pumped the breaks but i was still unable to come to a complete stopso i avoided the person in front of me the best i couldby turning off the road and we hit corners of our cars, it was a solid hit but when we got out and looked at it there appeared to be nothing wrong with her car. the only thing she asked for was my name and number and we went on our marry way. then four days later (today) she calls and leaves a message saying there is fender damage and it costs about 275 dollars and that the car is a lease so she needs it quickly.

Whats rights do i have? Do i have the right to see the estimate? Should insurance companies be involved? Anything else?

  1. Your rights were thrown out the window when you did not get a police report.

You need to call your insurance company "NOW" and tell them everything and you should get some type of report from the police department as well for your protection.

  2. You have the right to see the written estimate,  and to go take pictures (should have done that at the scene anyway).

You hit her,  you pay.    No question there.    If only $275,  probably not worth giving it to your insurance.

  3. Well, if you go into the back of somebody it is usually seen as your fault by the insurance company.

I would meet her at the garage and pay the garage after the work has been done. Better to come from your pocket rather than your insurance, as it could make your premium go up.

  4. definatly get verification of the "estimate" and if there really is damage then better of paying then..

  5. sure you have a right to see the estimate. you cannot always see damage some of it may be hidden. contact your ins. carrier that is why you pay them.
