complete stop to prepare to make my turn, i am always looking around to make sure no one is walking around i then see the truck driving backwards, i honk my horn i did not have time to move he ram right into me. he was driving a rental truck and stated he is not use to driving the truck. but now with his insurance he is claiming we both was backing at the same time which is not true. the police did come out and gave me his info. i am wondering by the damage that was done will they be able to tell what happen and i do have a witness but do not want them to talk to the insurance due to their tricks. the back panel on driver side was dented up

Depending on how large the city and police department is will be a determining factor. The officers who worked the accident are trained to look for certain things to figure out exactly where it occurred and how. THese can be determined by facts not statements. Some problems that arise are How much the officers care and how busy they are. Another issue is insurance companies review the police reports but dont always go by them. If there is any doubt on the chain of events insurance companies typically just settle out between themselves and sometimes blame both drivers. The best thing you can do is get a copy of the police report yourself and talk with your insurance adjuster with your witness. I dont recomend going to the other guys agent. Keep in mind insurance companies have a lot of money and will do what they want because they can. And even if it is declared the other guys fault some companies will still raise your rate because of bad luck.
