I was in an auto accident with someone who did not have a license?

Yesterday I got into an auto accident with a man who did not have a drivers license. The officers that made the report didn't say for sure if it was my fault, but I rear ended him after he laid on his brakes to turn around or something without using a turn signal(I'm not sure what he was doing, he barely spoke english) I know that the basic rule is if you rear end someone it's automatically your fault, but someone told me in kansas that if you for any reason get into an accident with someone that doesn't have a license then it is immediately either their fault or a no fault. Anyone that could shed some light on the situation would be much appreciated.

  1. Unfortunately, It doesnt matter if the other driver has a license or not, or if the accident happened in Kansas or Munchkin Land. You rear ended him, you are at fault.

    Turn the claim into your insurance company. They will cover the damages to the other party. If you have collision coverage, they will repair your vehicle as well, but you will have to pay your deductible.


  2. OK, I'll help you with this - the accident is your fault.  Not having a license does NOT change the fault of this accident - that someone is dead wrong about that.

    SOME states are a "no pay no play" state, where if they were driving uninsured, and you cause the accident, they can't collect.  But KANSAS is not one of these states, as far as I can tell.  

    Bottom line - you're at fault, his lack of license is irrelevant.
