I had a distal third fibula fracture as well as a comminuted distal tibia fracture involving the ankle joint. I had an external fixator until the swelling went down. I then went for surgery to have a plate in my fib. and s***w in my tib. I also had another fixator put on. I had the fixator removed May 21. My dr. says that I will never have a normal leg. I will always have stiffness and swelling that will be difficult to overcome. Its also a possiblity that I will have to have an ankle fusion later in life. I also will have scarring on my leg from the fixator and surgery. My medical bills are $100,116.00. They have my future medical bills at $166,578. My lawyer told me that my claim was worth between $500,000-$750,000. He is going ahead to make the claim without Medical Maximum Improvement. Does this seem like a good idea?

What's the extra 600,000 for?  You take a risk driving because these things happen.  If it had happened skiing you would get nothing.  Feel lucky your bills are being taken care of.  I would no be able to sleep if I ruined someones life over an accident just to get money.  Just get all your medical and attorney fees taken care of.


  2. Well, if you do not trust your attorney's advice, then get another.  It appears that you are at MMI, and no further treatment, aside from the potential future fusion is expected.  If you are still treating, then yes, he should probably wait

    The demand is realistic which is surprising actually, but what are the policy limits of the other party?  If they are only $100k, that is all you will get unless your attorney plans on going after assets.  This could be one of the reasons he is settling now.   What are your Underinsured limits?

  3. He should be going after full policy limits of the other party & then turn around and place a claim on your own underinsured  motorist.  

    Sounds like he knows what he's doing.
