I was injured at work by a delivery man that is not an employee of our company.

I am already receiving Workers Compensation for the medicals and disability. Can I sue this delivery man and/or his company that dropped the equipment on my leg? If I can, do I need to pay back my employer?

  1. Sure you can sue them!  As your employer isn't paying anything, you don't pay the employer back.  You'd have to pay their insurer.


  2. You can't sue. This is the basis of workman's comp.  If there is any sueing to do, they will go after the deliveryman's  liability carrier.

    This is not your concern.  

    Even if you did, the comp carrier would expect you to reimburse them any money you won. Just forget the  whole idea.
