I was involved in a car accident today. Look at scenario. Who will pay?

I was coming north on a busy street and made a left turn at a green light. The car "came out of nowhere." I'm sure alot of people say that. Anyway, he seemed to have sped up and didn't break. He ended up hitting me on my back passenger side, denting it in. It damaged my car of course as well as his front end and his windsheild is smashed (not in but like a spiderweb) and his airbags went off. I was not given a citation and believe that is is my fault even though he was going awfully fast to come across the light. Who's insurance will pay, mine or his or will we both take care of our own? Please be courteous. It was an ordeal. Thanks!

  1. The only things you should have done were 1) get a police report and 2) take photos - even if just with a cell phone camera...If you did not take photos right after the mishap, go back and photograph the intersection, looking for skid marks especially...Be careful doing this...The report and the photos are the only pieces of impartial evidence that you would have.

    Yeah, the guy turning left has to yield to oncoming traffic, but there may be extenuating circumstances...See about the police report and your photos, then see the insurance folks...I'm real curious as to why the other guy's windshield cracked...Seatbelt not fastened maybe??

  2. Yes it is your fault for turning into oncoming traffic and failure to yield.

    Your insurance will pay as long as you dont live in a no fault state.

  3. Let your insurance company deal with it but make sure you see your physician about getting some help coming to terms with this accident. You need to get your confidence back again after such an ordeal.

  4. Sounds like you may need some witnesses, if he sped up, as you say, the light may have been changing while you were turning, which will put him in the wrong.
