I was mowing city property?

by the road and i slipped on a wet spot and fell under the mower..can i sue the city?

  1. the city did not ask you to mow it. you did out out of good graces, true? since you were on city property, isnt ths considered tresspasing?

You might actually have grounds for a case, but it will be a real uphill battle.  If there is some sort of city ordinance that says that property owners should mow the grass, you could make a case that the city failed its duty by not mowing, creating a situation that forced you and others to mow to correct the city's repeated failing.  Under this legal theory, the city would need to be aware that you and your neighbors mow and therefore that your injury is foreseeable.  If you really want to sue, you should file quickly and hire a lawyer who will take the case on contingency--I don't recommend that you spend a lot of money or other effort on this loser of a case.  

  3. The city is not a guarantor of the safety of trespassors who cut lawn that doesn't belong to them.  If you have evidence of some negligence, that the city breached some duty towards you, then you can sue for your damages, but the mere fact that you were injured does not mean that someone else is responsible for your injuries.  If you were on the payroll of the city, or even performing community service, you could qualify for workers comp.  If you were not working for the city, you have no claim.

  4. You don't have a case.  You took it upon yourself to mow the property that doesn't belong to you and therefore you are responsible for the accident.  You should have complained and waited for them to mow.

  6. Blaming someone else for your own stupidity and get compensated for it, is your purpose on asking this question. Why don't you do what you want.

    This is nothing different in the McDonald case, they got sued because they serve a hot coffee.
