I was on a private lease, not through a real estate. We had to break lease early and find somewhere new. The owners decided to list their property with a real estate, who then charged the owners a 'letting fee'. The owners are now tring to pass this $360 fee to us, the tenants. Is this right? It doesnt seem fair as its not a reasonable cost, the owners listed the property with them of their own free will and we had nothing to do with real estates for the duration of the lease. The owners created the lease. Our weekly rent for the house was $330 per week so this fee seems illegal.

  2. not 100% sure myself, but that doesn't sound right. At all.  Don't pay it until you are 100% sure you need to.

  3. I don't think it matters whether you have a lease with a real estate or a private lease - if you break it you are responsible for the reletting costs which is usually one weeks rent. You are also responsible for any advertising of the property ie. internet, papers etc. Your probably lucky the fee isn't higher.

    It doesn't matter whether it's the real estate or the owner who wants to fee. You've broken the lease and you are eligible to pay the reletting fee whether it be to the owner or the real estate - it's just in this case it's the real estate that want the money. I understand that it was a private rental - but if you take the real estate out of the questions - the owner is still able to take you for that money. You've broken the lease and it's your obligation to pay the money. Ring any real estate in QLD and they'll tell you the same thing. If the owner wanted to take you to court over the matter he could and he'd win.
