Question:

I was racing someone, they got mad i was catching up and slammed on their brakes, if i hit them who at fault?

I know that rear ending someone would usually be my fault but this person got mad that my car was faster and deliberatly slammed on their brakes when I caught up. Isn't that the biggest jerkoff thing to do by risking their own lives and me and my friends just because their car sucks? What would the law have done if I did not have my heads up and there was a huge accident going about 80 mph? I did nothing to them except catch up and most guys are just having fun and would never do anything like that. Why would they do that to themselves and others?

    Being in an accident as a result of the racing would be an aggravating factor.

    Here, you would be both charged, both have your vehicles impounded.

  3. some people are in this game to make money and you, by chasing him down and racing placed yourself in that situation where you could possibly rear end him and make him and all in his vehicle a whole lot of money and a new vehicle. He baited you and your big fat ego took the bait and placed yourself and all in your vehicle at risk

  5. Many automobile insurance polices exclude coverage for racing.

    So be sure to tell the adjuster just what you told us. Then they can deny coverage and the guy can sue you personally.

    The guy did not risk your life by breaking.

    YOU risked your life and the LIFE OF EVERY OTHER MOTORIST ON THE ROAD when you got the bright idea to street race.

    You are a victim of your own stupidity.  

  6. You both would be charged for street racing and public endangerment, and probably both charged with reckless driving.  You would also be charged with following too closely.

  7. Since both vehicles were being used in the commission of a crime at the time of the crash (street racing is a crime), in this situation you are both at fault.  You are also both lucky that you were not killed in a high speed crash.

    There were a couple of real "jerkoff things" done in this situation.  He did a jerkoff thing when he stopped short attempting to make you wreck into him, you did a jerkoff thing when you decided to try to catch up with someone that passed you on the road!

    I like how you say "they passed me and instigated the race ...".  How did they instigate the race?  By just passing you?  Did you think that you had something to prove by catching up with them?  

    The police report would include information concerning the approximate speed of the vehicles at the time of the crash, based on physical evidence like skid marks and damage to the vehicles.  The courts would use this information to help determine fault.  Had there been a wreck in this case ... the decision should have been equal fault to both drivers.
