Question:

I was rear ended on Hwy. at a school bus exit can i sue the state for improper warning signs and/or signals?

What happened wasthere was one school bus waiting to turn on to Hwy. someone in the right hand lane decided to stop and wait for the bus as i approached the intersection in the left lane i seen a cop car on the median with lights on the Officer was doing something in front of the car, but it appeared as if the cop was in the car so as i approached the intersection at 45mph which is the speed limit he jumps to the side of the road and signals for me to stop i hit the brakes and down shifted to a stop perfectly on the line. The truck behind me slides into the passenger side rear of my car at 45mph and my vehicle rolls foward about 20ft. there is not much warning for this intersection exept for a flashing 20mph school zone sign which was not flashing because there was only one last bus leaving. The tricky part is that the cop has stated that he "DID NOT INITIATE A STOP SIGNAL" and that i made an Improper Stop and that the driver behind me was following to closely no tickets were givin 2us

  1. This is what I do for a living,  no your case is not with the state or the officer, it is with the vehicle that struck you. Anytime you rear end a vehicle in front of you, you have failed to maintain control. Now, what state you live in makes a world of difference, so I can't give you the old adjuster's opinion without knowing that, If you live in a pure comparative state, up to 1/2 the negligence could well be assigned to you. The situation you described is an accident waiting to happen.  It would have been a really good time to back off of the gas. I think this would be a very good case to settle out of court, a good attorney would take the story you have related here and crucify you with it.


  2. I would say that this sounds like a road that is traveled on by you many times and you were not paying attention.

  3. i persoanlly think you should have gotten a ticket for stopping like that. you never just STOP especially on a highway. If a cop is singling for you to pull over.. you pull over not jsut stop. are you a young driver??? i dont know if i misread that but it seems as though you were at the wrong.

  4. how did you make an improper stop if the cop signaled you to stop. have you been through this intersection before and if so you should be aware of it
