Question:

I was scared into taking a plea even though I am innocent. How can I go back and do it over again?

Someone stole my friends sterio and he thought it was one of my other friends. So we went over tothe house to see if it was there and my friend let us in just to look around. I stood against the wall and watched my buddy look around for his stereo and all of a sudden he flipped out and grabbed a knife out of the kitchen. Long story short since I was there I was charged with home invasion 1st degree wrongful imprisonment and assault with a deadly weapon all because I stood against the wall. and to top it off the kids envolved were lying and said that they never let us in, we barged in like a bunch of gangsters and ran their pockets and holding knives up to their throats. One girl said I told him to stop... so what scared me was the home invasion first degree if charged with that the sentence goes up to life in prison.

so they offered me 2 felonies and 3 years probation... and my lawyer told me to take it even though I told him my side of the story and that I'm innocent... then after the judge sentenced me he says "nice meeting you" to my lawyer so they screwed me over and I want justice... I need some lawyers advice

  2. As much as it sucks, you can't. You can't reverse your plea if you have already been sentenced. It's too late now. The decision has been finalised.  

  3. Sorry but you're SOL.

    You should never have taken the plea if you were really innocent.

    Worst case scenario if you would have plead not guilty would be them finding you guilty anyways.

    You probably wouldn't have gotten much, depending on your state.

    And honestly, you being a young girl, they probably would have let you off real easy.

    You could probably pay a lawyer a lot of money to get it off of your record though.
