I was waiting to turn right out of my apartment and a person came up to the left lane and then turned right?

I was waiting to turn right with my brake lights on and no turn signal on in the right turn lane of my apartment out to a busy road (no hazard lights on). Suddenly a person came speeding up from behind and went into the left turning lane. As I waited to turn on the busy road this person suddenly turned right into the traffic as I started going but slammed on my brakes. If there were an accident who would have been at fault. Although I admit I did not have my turn signal on but brakes lights were on and no hazard lights activated (if this person said they thought my car was disabled).

  1. Him for making an unsafe lane change while entering a roadway. But NEVER accept any responsibility at the scene. Let the claim adjusters or cops handle that.

  3. According to what you have stated, it really depends on where the collision occurred. In the street on in the parking lot area.

    Now lets say you were in the street area. The law does not decide "who is at fault" the law only decides what violations have occurred. Can the officer prove that you had your signal on or off? Well you have better put it on when you got hit. The violations, will help the insurance company determine who is responsible. Never say you were at fault.... only say you were cited for a violation.

    Now let look into the damage to the vehicle. If you had damage on your left front fender and the car had damage on its right side, can the person say that they were traveling down the road, and you pulled out,,, it all depends on the damage. What do the witnesses say?

    Now lets look as if it was in the parking lot. Most states do not or cannot enforce violations on private party, when it comes to traffic collisions. What they can do is other violations, such as DUI, suspended DL, etc...  Most places they don't even write reports, just issue private propery crash cards, to show the insurance company that there was a collision. I always recommend getting ahold of all witnesses, and calling the police.

    If your car was disabled, was it still running,,, why were you in the car anyway, you would have been out of your car.

    The person who passed you was probably and idiot driver, on the telephone.

  4. Even though you didnt have your turn signal on ( you should have, you know), this person did not give ample time to safely access whether you were making a turn or disabled, therefore they would have been at fault.
