I was wondering if anyone knows how long an employer has to pay you you weekly check?

Place of employment has been closed for 2 weeks due to unforeseen circumstances.

  1. If they've closed (and filed for bankruptcy) you probably won't be seeing your last paycheck.  It's one of those "life is unfair" things, where you can love your job, but it will NEVER love you back.  Find another one, work to live (don't live to work) and you'll be okay.


  2. If they're not paying what they owe, tell them you're going to small claims court.

  3. Same thing happened to my friend, he had to bring them to court to get the pay. But in the end they had to pay all the court cost.

  4. Did the place go bankrupt? You need to check on them and see what is going on.  Public court records are on the internet.

  5. They have to pay you for the hours you actually work.  If they are closed and you aren't working, they don't have to pay you for that time.

  6. Unfortunately, there is no requirement ;(

    If they are closed due to unforeseen circumstances and those circumstances are related to their ability to stay in business then they could likely file for chapter 11 reorganization.  If that's the case, you will have a liability against the company (your paycheck) which will go into the big pile of liabilities that others have on the company.  It's a worse case, but if it happens, you are basically fighting with all the creditors (banks, utility companies etc) to get your "piece" of what's left.

    That said, if it's not related to their ability to stay in business, I'd suggest calling the owner, or manager, and reminding them you haven't been paid and ask them for a date when you'll receive payment.  If you can, get them to set a date and then at least you can manage to it.
