I work for a temp co in Texas and fell on the job?

I fell into a drainage hole that has no fencing, grate, etc. I didn't feel that I needed to go to the dr right away. But on the way home filled out necessary paper work w/the temp co in case I was feeling worse in the morning. I was worse. Got an appt. through the temp co w/their dr. Missed that whole day of work, a Friday, so I lost out on o/t too. Now just because the w/c in Tx says you have to be out for 8 days before they pay you, I feel the Express personnel should make up for the 92.25 I missed. (as a result of that, I couldn't pay my cell phone bill and now it's cut off. So the p/t people couldn't reach me to set up an appt.) I feel that since I need to get p/t, I should be reimbursed for my time & not have to work through my lunch. As it is, I have to work through lunch because we're busy! That's my o/t! Help! Never did w/c before. And you know it's a small town, so giving the co. grief will s***w me up for other agencies.

  1. OK, first of all, although TX doesn't require a company to carry workers comp, they're still on the hook for the benefits.

    Unless you miss 8 days BECAUSE THE DOCTOR SAYS YOU CAN'T WORK, ie, you are disabled, you can't get lost wages.  Missing work, because you were at the doctor, doesn't count.  "FEELINGS" have nothing to do with it.  You do NOT get paid, for the physical therapy appointments.  Feelings, again, are irrelevant.

    Just pretend you walked into the ditch on your own time.  Then be glad you can at least work through lunch, and take a couple hours in the afternoon to go get the pt without being let go.

I don't know how WC works when you're working thru a temp agency - I think you might have some kind of claim to the actual employer you worked for - there usually is a waiting period for WC benefits, but if you used their doctor , etc, the medical part should not cost you anything and if you are actually back to work already, you probably won;t be able to collect anything
