I would like some advice on Identity Theft please..?

My check book was stolen and someone wrote a check to FoodMax. The ID # on it and the signature obviously did not match.

I fairly believe that is the store's clerk duty to ask for ID and compare signature and the person's name etc.

Can any legal action be taken against FoodMax for Negligent?

Please help.

PS: I have cancelled this account shortly after i found out.

It is difficult to take actions against FoodMax.  It is their internal store policy that determines whether a clerk should check for ID and compare signatures.  However, your bank cannot deny the responsibility.  The bank has your signature card which you have done since the account opened.  They should have reverse the transaction once they found the mistake.
