I would like to evict a roomate, can I write up my own 30 day notice or do I have to do this legally?

My name is the only one on the lease. I have asked kindly for them to leave but they refuse. I live in NYC. What are my options?

  1. You can write a 30 day notice to evict, and hope they leave, but if they refuse to leave you have to go through the courts to legally evict someone.  That could take 60, even 90 days or more depending on the court case loads.  And it doesn't matter if you're the only one on the lease, if they have paid rent or were supposed to, they are a legal tenant.

  3. I don't know about NYC. I would call an attorney annonymously though, and ask. Sometimes you can get free consultation/s. Then I would learn from this. Move on and not worry. : )

  4. If you name is only on the lease yes you can throw them out they are only a guest in your home. Also so you already gave them notice to leave. just put it in writing for you own protection. But legally they have no right to be in your place.

  5. You have to do it legally, but writing up your own 30 day notice IS doing it legally.  Then again, the fact you have to ask probably means you need an attorney to do it RIGHT.
