I would like to know, since a US president can serve only 2 terms, ?

Can he become a Vice Presidential running mate or Vice President since he has never served in that capacity?

  1. No because if the president was killed in office then he would become president.

    22nd amendment:

    "No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."

  3. Not likely. If something happened to the President and the Vice President could not take office because he had already served two terms as President, there is potential for a Constitutional crisis.  

  4. This has been answered before but you cannot be a VP if you are not eligible to be the President.  So, if someone considers an ex-President, he cannot be an ex-president that served 2 terms.

    The 22nd amendment states:

    "Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term."

    In and of itself this does not prohibit a former president from running for VP, however when taken with the 12th amendment:

    "...no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

    Therefore because a former 2 term president is constitutionally ineligible to the office of President, they are also constitutionally ineligible to the office of Vice President.

  7. Yes.  The President is limited to serving two official terms as President.  Ascending to the presidency due to the death of the president does not count as one of these terms.

    Most presidents wouldn't want to serve as vice pres after being the president, but there is nothing stopping them from doing this.  If the president died they wouldn't be precluded from finishing his term, but they wouldn't be able to run again as President.  

  8. Yes, he could, by the Constitution.  But no, it's unlikely, since the main responsibility would be to take over if the President could no longer be President.  That person would automatically have to resign, and the Speaker of the House would be next in succession.

  9. Actually, there is no real answer to this. That's because it has never been tried. One reading of the Constitution would say that a VP candidate has to have the same qualifications to hold the office of President as the Presidential candidate. But since this has never been brought up before a court, it is unknown if that is the meaning.

  13. No the Vice President must be fully qualified to step in as President at any time. 2 terms would disqualify him/her.

  14. It's actually an undecided area of Constitutional law. The twelfth amendment might outlaw it (since it applies all conditions necessary to be president on the VP) or it might not. It would be an issue for the Supreme Court, but not one that's likely to be resolved soon, since most presidents retire from politics after their second term.
