I would like to travel out of US with my 10 yoa daughter.?

I am getting a divorce and her father will not sign passport application. Also I believe I need to bring a letter of permission to leave the country from him with us with current dates everytime we go somewhere out of the States. Any advice or info?

  1. I believe that unless you have sole custody of your daughter he has to sign the application.

Yes, the rule is that in order to get a passport and visa, you have to have both parents there to sign, OR a notarized letter giving permission.  You also have to take a letter notarized by him stating that he gives you permission to take his daughter out of the country.  He has to put the dates that the visa states on the letter - if there is no visa required, he has to put the dates of the plane reservatioins.

    We have family in Russia and a small son - we have researched all of this because I am sick and although I was able to go this time, I may not be able to in the future.

    The only advice I have is to talk to your divorce attourney.  They may be able to make some deal with the other attourney. Also, I can see his side of things.  If the divorce is contentious he may be worried you won't come back.
