I am married to an American however, I am Canadian. My husband and I just found out that I am pregnant and I am wanting to move to the United States to be with him. He is currently in the Air Force so is unable to move here. I was wondering what ID is required to file? I have my driver's license however, it expires next month. I was thinking of getting a passport but is that enough along with a birth certificate to file??? IN simpilar words...is a passport wtih a birth certificate enough to file for green card. Thank you to anyone who answers.

  1. Go to the USCIS website. Find the section on forms and/or benefits. Find the form I-130. Download the instructions. The instructions will tell you which forms you need to start the process.

Your husband is the one who needs to submit the I-130 to CIS along with the fee and the supporting documents.

You are going to need your birth certificates and your marriage certificate among other things. You do not need a passport now. You might later, but not at the moment.

  2. yes. i sent a photocopy of my passport, birth cert and etc when i was filing for AOS and it was enough for USCIS

  3. You absolutely, 100%, need a Canadian passport.  Whatever Canada requires to get that is up to their government.

You stand no chance of getting the K-3 visa before the child is born.  Expect it to take about a year.

  5. You will need a lot more than that.  Your husband will need to sponsor you etc.  You will need a passport anyway so you should apply for one.  Please see the USCIS site for details.  You need to file for the K-3 visa.  If you cannot come to the US in time, you should ensure that you register your child's birth with the US embassy so that he/she can be registered as an American citizen.
