I PLAN ON MARRYING MY BF HE IS FROM MEXICO AND I JUST WANNA KNOW HOW LONG WILL IT TAKE HIM TO GET A GREEN CARD N HOW LONG DO THEY MAKE HIM GO BACK TO MEXICO FOR AND WHAT ALL DO I NEED TO MAKE THIS HAPPEN

  1. if he came legally and overstayed then he would only have to pay a thousand dollar fine. But if he is otherwise fine, then it will only about 6 months for him to get his green card but it will take 3 years for him to get naturalized and become a U.S Citizen


  2. i don't know why people think you can just marry someone and poof they are legal. it does not work that way. maybe you should move to mexico and get married there and stay there, and not come back


  3. It would take a long time. If he entered the U.S. illegally and he has been in the U.S. for a year or more after his 18th birthday, he is subject to a 10-year bar. When he goes back to Mexico, he will be ineligible for a green card for 10 years. He might get a green card earlier than that but only if he is granted a waiver first.

    You cannot anticipate a favorable decision on the waiver application so if he returns to Mexico to apply for a visa based on a marriage to you, he is facing a 10-year bar unless the waiver is approved.

    If you decide to marry, you can submit form I-130 to CIS along with the fee and supporting documentation. That's how you would get things started.

  4. I would call a lawyer and ask because your not going to get good advice here, most people dont know what they are talking about.  

    People always say there will be a 10 yr ban Blah Blah Blah... Not if he returns to Mexico and then you do the proper paperwork no one will ever know he was in the US illegally.  

    I wouldn't get married here and then try and get his green card because they will figure out he was here illegally.  I would either have him go back and get the fiancée visa or you go there and get married.  That way no one will know he was here to begining with.

    Side note-   Even if caught its not ALWAYS a 10 yr ban.  Its UP to 10 years.  It depends on the what happen, criminal charges, etc etc etc...  Unless people have first hand experence they dont always know what they are talking about on here.

    AND not every illegal mexican wants to get married for their green card and leave the person. I know plently that have been still married to us citizens after 20 yrs of marriage.    

  5. You can't just get him a green card,it doesn't work that way. He has to return to mexico and may have to stay there for 10 years. You should let him go and find yourself someone who isn't a criminal.

    he will probably end up leaving you after he gets his card, that's what most of them do (it has happened in my family)

    all you are doing is supporting his cause
