IF i DONT HAVE A LEASE AM i SCREWED NOW THAT LANDLORD SOLD ???

I have benn renting to two rooms in a house with my landlord/roommate and another renter.

I have ONLY been here 1 month and we agreed Id stay until May 15th 2009

BUT I dont have a formal lease, he just assured me that yes I can rent until then..

But now his Mom died, he lost his job and got new one out of state. H esaid he sorry but has a buyer and I have to out in 6 weeks. He has written me signed notarized note that he will reimburse me rent because he feels badly...

BUT i want to stay! This is a really good deal.

Can I somehow stay here until may ?

  1. No. unless the new owners allow you. but they cant just kick you out onto the street either. Start looking for somewhere else

  3. The only way you could stay is if the buyer agrees to let you stay. Other than that, you don't have a chioce.

    It sounds like this is a house, not an apartment complex, so if this is the case, then I doubt someone will want a stranger to live with them.

    Look around for a place to live, but see if you can't find out who is buying the place, and see what they will do with it. They might keep it as a rental place, and you can continue to rent a room.

    that.  Thus, unfortunately, you have no standing.

    The only chance I see is that you have performed and the agreement

    was.......[called a bi-lateral contract].........but again, that would be

    good for up to one year.  

    GET what ever $ he is offering and part ways amiably.

    You are renting out rooms - not a separate apartment.

    Not formal lease equals a month to month tenancy by default.

    A month to month tenancy can usually be terminated with only one month's notice (or less). Your landlord has given you more notice than is required and it refunding your rent. He is being overly generous, take the deal and vacate.

    Don;t try to ride it out. You'll end up having to leave anyway and will have an eviction on your record. The eviction will haunt you for years and make finding a rental in the future much harder.

  6. the signed notarized note is worth no more than a memo on a post-it on your door.

    The owner can evict you if you refuse to move on your own, but that will take a court order through the Unlawful Detainer Action. Then you and the LL will have to appear in court, you have 30days from time of legal service and the court renders in the new owners favor and you get out or the sheriff comes and removes you and your PP (clothes)

    ride it out as long as you can, but w/o a lease, you're doomed to be ousted.
