IPod touch 2.0 software upgrade

so if anyone's heard, you need to buy the ipod 2.0 software upgrade if you want to buy games. i really want games, but can you get it for free? i read on someone's question that they got it for free and idk how. but i don't want to do anything illegal. if not, it's ok, i was just wondering. and sorry if this question doesn't make any sense :p

you can get it illegally by jailbreaking it but that cancels your warranty...

im going through the same dilema, i have a touch but dont want to pay the money. if you do decide to jailbreak just go on google and search "jailbreaking ipod touch" and that should do it. hope i helped you
