I am 17 years old and have had 2 jobs in 2007. all i filed was about 2k on my tax return. My mom filed for me also. Can she claim me even if i claimed myself?

  1. No you can't both claim you.  At a guess, she can legally claim you, but you can't claim yourself.  You can still file a return though, and get your refund.  If your income was around $2000 you'd have gotten the same back whether you tried to claim yourself or not.  But if you did claim yourself, you created some extra paperwork for both your mom and yourself.


  2. If you filed, noting that you were claimed by some one else, all is fine, and you got back your withholding

    you are not self-supporting on $2000, and your mother could properly claim you as a dependent

    There is no benefit to you to claim your own exemption in this case

    If YOU improperly claimed your own exemption, stating that no one else could claim you, then you will have to file an amended return, or the IRS will be asking questions of both you and your mother

  3. Your mother may get a notice saying that her tax return has been adjusted automatically by the IRS and that she will not receive the refund she expected. If this happens, you will have to file a form 1040X, an amended tax return for yourself and remove your claim for an exemption. In the explaination section of the 1040X, make sure to list your mother's name and SSN as the person who is qualified for the exemption.  

    This will have to work its way through the IRS maze of computers -  perhaps about 2 or 3 months (Yes, it may take that long. Don't rush it or you will confuse the entire process.). Your mother should answer the IRS letter by writing a letter of explaination and enclosing a copy of your amended return.

    You will have to be patient. Remember, YOU created this mess, not the IRS. By remaining respectful and cooperative, I have had excellent results for my clients when dealing with the IRS.  

    At this point, ALL correspondance with the IRS should be mailed certified mail, return receipt requested.

  4. Based on the description you gave, your mother was eligible to claim you on her tax return--and did.

    When you filed, you would have answered a question that asked can anyone else claim you?  You were supposed to check yes.  Since your total wage income was $2000, you would not owe any taxes no matter how you filed.

    However, if you did claim yourself (go look), you would need to amend your return and remove the exemption so that it does not conflict with your mother's return.

  5. Both of you can not claim your personal exemption.  Given your income level it would appear that it would be best for your mother to claim you as a dependent.  You will have no tax liability with a 2k income regardless.
