Question:

IS THIS REALLY POSSIBLE,DOES THE LAW REALLY WORK LIKE THAT?

In May I was doing some repair and clean up jobs on a rental house, painting, floor repair some shingle repair, along those lines. I had different people stop by and help me, some was family some was just friends of family. I had this one guy that like me and wanted me to date him. I made it very clear to him I was not in any way interested in him as a boy friend or dating him. He lived about 30 miles out of town, he would stop by the house when I was working and I did ask him for some help. He cut down a tree for me and did some floor repair, and hung some lights, the whole time I was right beside him helping picking up tree to haul off holding flase light while he was putting bricks under the house, he put some shingles on the roof, I help the ladder so it wouldn't slip out of place. He called me up on the phone at my house in July the 1st and wanted me to spend the day with him on his Birthday July the 3. I told him I already had plans. The next night he called again and ask me to spend some alone time with him on is birthday. Again I told him I had plans. He started cussing at me and told me THIS IS NOT A ONE SIDED RELATION SHIP. I was so sick in my stomach because I never once wanted him to think I like him in any kind of way. I made it very clear to him that there was no kind of relationship between us and I was hanging up. I wouldnt anwser any more of his calls. He stopped by my house a week later and dropped of a Bill for $559.00 Has listed down on a peice of paper every thing he ever did to help out and a different charge even charged me $129.00 for gas for driving back and forth to town. I never once told him I was going to pay him. I ask him if he would leave me the bill so I could look it over and he didn't leave it. He called a couple of days later but I never answered the phone. Today I got a summons to go to Court, He is asking that I pay him 729.00. He is saying in the Summons that I called him on the phone and ask him to come over and do several jobs for me and that I have the money to pay him.

That just is not true, yes he help me do several jobs around the house, he even brought his riding lawn mower in town and mowed but I was there the hole time helping him. I never once told him a was going to pay him. I went and talked to the Judges clerk and ask if this is possible and she said yes anyone can file a summons against you. My question is, Am I going to have to pay him for every time he helped me? Does the Law really work like that.

  1. by asking him to leave you the bill so u can look it over, it implies that you intended to pay him.  


  2. No.  First, bring some friends that just helped out, and that none were charged.  Bring your phone bill showing you did not call the times he claimed.  Bring friends also who can testify that you told him you were not interested in him.  (They had to have heard him ask).  

    Let the court know he never left a bill with  you.  That the fact was, "There is no account stated", and had he said, he wanted money for his help, you would have turned him down.  Do not interrupt him.  Just make notes of what he lies about.  Be very polite and dress nice.  Good luck.  

  3. go to court, He tells his side, you tell yours,  judge decides.

    Since he s sueing the burden of proof is on him that you had a verbal contract to pay him .

    Just tell the truth as you did here and you should be ok.

    Anyone can sue for anything..but winning is another thing.

    Just watch Judge Judy.  You case sounds just like many on there.

  4. That is up to the judge to decide. He can sue you for payment, but only the judge can make you pay it. Just tell your side of the story and you should be fine.
