It's not worth it.  Take it as your idiot life lesson learned and move on.  If $400 is going to make or break you, then you've got bigger issues than him owing you $400 anyway.

To be honest $400 isn't even worth all the hassle.  You'd have to show written proof that it was a signed contract that he would pay you back.  It's a pain in the butt, so it's better just to suck it up and consider it a loss.

Why not ask your ex to pay you back in small installments over several months?  My husband's ex-wife took $500 from an account which was opened in order to keep track of their kid's money.  He told her she needs to pay it back to him (he was the only one putting money into it).  She pays in small installments over many months.  BTW-He closed the account.

Just file it.  You don't need an attorney.  Just get the form from the courthouse and file it.  The filing fee is under $50.

If he's an idiot, 400 bucks is worth just forgetting about him and he'll probably go away. Then you won't have to deal with an A@#hole like that. Find yourself someone new and try again.

It wouldn't be worth your time or the trouble to take him to small claims court. I honestly don't think you will see that money again. If I were you I would just move on.
