I was just wondering about this. If a police officer was in pursuit of a fleeing suspect and the officer gets hit by a car, or falls and breaks something while chasing him; is the suspect at fault for those injuries and prosecuted for it as well?

  1. The suspect is prosecuted for the crime. If he intentionally assualts a police officer, an additional charge is added.

  2. Yes they are responsible, if while in a criminal act, law enforcement or anyone is injured.  xox

  3. Yes, the suspect/defendant will be prosecuted for any injuries and damage as a result of the chase.  In CA, we have specific penal code sections dealing with this issue and they are serious and violent felonies, for purposes of the Three Strikes Law.

  4. It really depends on the circumstances.  If the pursuing officer clips the suspects car and then hurts himself - then, "yes" perhaps they could be charged with further charges.  Or if the suspect tries to ram the police officer.  But, if they're just chasing the suspect and then there is an accident where the suspect hasn't directly been at fault other than fleeing - then they will probably just be charged with resisting arrest and fleeing.
